  21. NIKON License Agreement

This page contains the Zensō EULA and the original Nikon EULA text. This agreement covers Zensō’s current app behavior: camera connection, Live View, remote shooting, gallery, downloads, location sync, notifications, Live Activities, and diagnostics.

1. Parties and acceptance

This Zensō End User License Agreement is between you and the developer or licensor of Zensō, not Apple. It covers Zensō, also distributed as Zensō 远映. Zensō is licensed, not sold.

By installing, accessing, or using Zensō, you accept this agreement. If you do not accept this agreement, do not install, access, or use Zensō.

2. License grant

You receive a personal, limited, non-exclusive, non-transferable license to use Zensō on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.

This license does not give you ownership of Zensō, its source code, Nikon software, Nikon command materials, or any third-party materials used by Zensō.

3. What Zensō does

Zensō is a remote shooting and photo management app for Nikon camera users. It may discover cameras on the local network, connect through PTP/IP, show live view, change camera settings, trigger capture, browse camera media, download files, save files to the Photo Library or Files, add optional location information, keep a connection active in the background when enabled, show notifications, and show Live Activities.

Camera behavior depends on the camera model, firmware, network conditions, storage state, battery level, camera mode, user settings, system permissions, and Nikon protocol behavior.

Feature availability is not guaranteed for every Nikon camera, firmware version, shooting mode, network environment, or Apple device.

4. Your responsibilities

You are responsible for using Zensō only with cameras and files that you own, control, or are authorized to access.

You are responsible for checking camera settings, focus, exposure, recording status, storage, battery level, capture state, transfer state, file destinations, and location settings before relying on Zensō.

You should keep independent backups of important photos and videos. Zensō is not a backup service.

Do not use Zensō where app, network, camera, transfer, recording, or location failure could cause injury, property damage, privacy violations, security issues, professional loss, or irreversible loss.

5. Restrictions

You may not copy, modify, adapt, translate, rent, lease, sublicense, sell, resell, distribute, publish, or host Zensō except as expressly permitted by this agreement or applicable law.

You may not reverse engineer, decompile, disassemble, decrypt, bypass, tamper with, or create derivative works from Zensō, except where applicable law expressly allows that activity despite this restriction.

You may not use Zensō to access cameras, networks, media, files, locations, or systems without authorization.

You may not remove, obscure, or alter copyright, trademark, patent, license, or proprietary notices in Zensō or in any Nikon or third-party materials used with Zensō.

6. Camera files, downloads, and metadata

You keep your rights in photos, videos, and other camera files. Zensō does not claim ownership of your media.

Zensō may transfer, cache, preview, save, delete, or display camera files, or update their metadata, only as part of the features you use. You are responsible for confirming the result of any download, save, delete, or transfer operation.

If location or geotagging features are enabled, Zensō may send location information to a camera or write location information to received photos. You are responsible for deciding when that information should be used.

7. Privacy and permissions

Zensō uses system permissions only for app features you enable or use, including Local Network, Location, Photo Library, Files, Notifications, and Live Activities.

Diagnostic logs and crash information stay on your device unless you export and share them, for example with support.

The Zensō Privacy Policy explains what is processed on device and what choices you have.

8. Nikon EULA and Nikon third-party beneficiary rights

Zensō may use or interoperate with Nikon software development kit materials, Nikon camera command protocol materials, Nikon documentation, Nikon specifications, or Nikon intellectual property. The Nikon EULA below is Nikon’s own EULA and is included here as original Nikon EULA text.

You must comply with the Nikon EULA and all Nikon-related restrictions that apply to your use of Zensō. You receive no ownership rights in Nikon materials; Nikon and its licensors retain all rights in them.

Nikon is an express third-party beneficiary of the restrictions on use, warranty disclaimers, support disclaimers, and limitation of liability terms in this Zensō EULA and in the Nikon EULA that relate to Nikon software, Nikon command materials, Nikon intellectual property, Nikon camera control behavior, or any Nikon-related component used with Zensō. Nikon may rely on and enforce those terms to the fullest extent permitted by law.

Zensō is not an official Nikon app. Nikon does not sponsor, endorse, operate, support, or warrant Zensō. Nikon and related Nikon marks are trademarks or registered trademarks of Nikon or its affiliates.

9. Intellectual property

Zensō, including its design, code, and name, is owned by the developer and protected by copyright and other laws. The developer, not Apple, is responsible for investigating, defending, settling, and discharging any claim that Zensō or your possession and use of it infringes a third party’s intellectual property rights.

10. Maintenance and support

The developer, not Apple, is solely responsible for providing any maintenance and support for Zensō, to the extent required by applicable law. Apple has no obligation to furnish any maintenance or support services for Zensō.

Nikon has no obligation to provide maintenance, support, updates, documentation, compatibility information, or assistance for Zensō.

11. Disclaimers

Zensō is provided as is and as available. To the fullest extent permitted by law, all express, implied, and statutory warranties are disclaimed, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, uninterrupted operation, and error-free operation.

No warranty is given that Zensō will work with every camera, firmware version, network, file type, storage device, operating system version, permission state, or shooting setup, or that camera control, live view, recording control, file transfer, download, deletion, metadata writing, location sync, notifications, or Live Activities will always work correctly.

Nikon software, Nikon command materials, and Nikon-related components are provided under the Nikon EULA below and are subject to Nikon’s own disclaimers and limitations.

If Zensō fails to conform to any applicable warranty that cannot be disclaimed, you may notify Apple, and Apple will refund the purchase price for Zensō to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Zensō, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the developer’s responsibility.

12. Limitation of liability

To the fullest extent permitted by law, the developer, Apple, Nikon, and applicable third-party providers will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages connected with Zensō, Nikon software, Nikon command materials, camera control, capture, transfer, deletion, location features, notifications, Live Activities, diagnostics, or your use of the app.

This limitation includes loss of profits, loss of business, interruption, loss of data, loss of photos or videos, failed captures, failed recordings, missed shots, corrupted files, incorrect metadata, device issues, camera issues, network issues, privacy issues, and other losses, even if the possibility of those losses was known.

To the fullest extent permitted by law, the developer’s total liability for all claims relating to Zensō will not exceed the greater of the amount you paid for Zensō in the previous twelve months or USD 50.

Nothing in this agreement limits liability where applicable law does not allow that limitation.

13. Product claims

The developer, not Apple, is responsible for addressing any claims by you or any third party relating to Zensō or your possession or use of it, including product liability claims, claims that Zensō fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

You represent and warrant that you are not located in a country or region that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

You will not use, export, or re-export Zensō except as allowed by United States law and the laws of the jurisdiction where Zensō was obtained, and you will not use Zensō for any purpose prohibited by United States law.

15. Third-party terms

You must comply with all applicable third-party terms when using Zensō, including Apple terms, the App Store Usage Rules, iCloud terms, your wireless data service agreement, Nikon terms, and open-source license terms.

Open-source components included in Zensō are governed by their own licenses. If an open-source license gives you rights that conflict with this agreement, that license controls only for that open-source component.

16. Apple as third-party beneficiary

You and the developer acknowledge that this agreement is between you and the developer only, not with Apple, and that the developer, not Apple, is solely responsible for Zensō and its content. Apple and Apple’s subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it, Apple has the right, and is deemed to have accepted the right, to enforce this agreement against you as a third-party beneficiary.

17. Entire agreement

This agreement, together with the Zensō Privacy Policy, the Nikon EULA below, and applicable third-party terms, is the entire agreement between you and the developer regarding Zensō.

18. Termination

This license continues until terminated. If you violate this agreement, your right to use Zensō ends automatically. You may end it at any time by deleting Zensō.

After termination, you must stop using Zensō and delete copies of Zensō in your possession or control, except where applicable law allows continued retention for lawful archival or device-management purposes.

19. Changes

The developer may update, change, suspend, remove, or discontinue Zensō features at any time, subject to applicable law.

This EULA may be updated when Zensō changes, when third-party terms change, or when legal requirements change. The date at the top of this page shows the latest published version. Continued use of Zensō after an update means you accept the updated agreement, to the extent permitted by law.

NIKON shall promptly provide PARTICIPANT with written notice of any such claim and reasonable cooperation, information, and assistance in connection therewith. PARTICIPANT shall have sole control and authority with respect to the defense, settlement, or compromise of such claim, provided that any settlement of such claim includes a full release for the NIKON INDEMNIFIED PARTIES.
